Zoning Change Approved to Accommodate Route 28 State Highway Improvements
Key Points
- Zoning adjusted to accommodate 10-foot state-mandated shared-use path on Route 28
- Property owners can now seek setback relief through a special permit
- Amendment passed with the required two-thirds majority
Town Meeting approved a zoning amendment for the Village Centers Overlay District under Article 29, a move intended to provide flexibility for property owners affected by upcoming state roadwork. The amendment addresses front yard setbacks along Route 28.
Town Planner Kathy Williams explained that Mass DOT is planning a 10-foot shared-use path along the corridor, which will involve land takings that push property lines closer to existing buildings. Without this change, many property owners would find their buildings in violation of zoning setbacks. The amendment allows developers to seek relief via a special permit rather than the more difficult variance process.
The change aligns with the town’s recently adopted Local Comprehensive Plan, which emphasizes modernizing infrastructure and improving coastal resiliency and pedestrian access. The article required a two-thirds majority and passed easily via voice vote.
Motion: I move Article 29 as printed in the warrant.
Vote: Passed by 2/3 Majority
